Legal Owner vs. Registered Owner
On a California vehicle title, the “registered owner” is the person who uses the car. The “legal owner” is the lienholder (bank, credit union, or finance company) that has a financial interest in the vehicle until the loan is paid off. When the loan is paid off, the legal owner releases their interest and the registered owner becomes the sole owner.
When You Need a Legal Owner Transfer
- Loan paid off — your lender sends you a release of liability form; we update DMV and issue a clean title.
- Refinanced with a new lender — old legal owner released, new legal owner added.
- Transferred the loan to a family member’s name — requires lienholder cooperation and DMV re-titling.
- Lienholder went out of business — we can help you submit the bonded title process to clear the lien.
What You Need to Transfer Legal Owner
- Release of interest from the previous lienholder (original document, not a copy)
- Loan payoff confirmation letter (if applicable)
- New lienholder information (if refinancing)
- Your current registration card and ID
- Transfer fee and title fee
Frequently Asked Questions
My loan is paid off but the lienholder won’t send the release. What do I do?
California has procedures for this situation. We can file a statement of facts and begin the formal release process. Come in with your loan payoff documentation and we’ll walk you through the steps.
How long until I get a clean title?
Once DMV processes the legal owner release, the new title is mailed within 15–30 business days. You’ll get a printed receipt immediately that serves as proof of the ownership change.
