A California title transfer is simple in theory but easy to mess up — and mistakes can leave the seller liable for the buyer’s tickets or force the buyer to pay duplicate fees. This checklist covers exactly what both parties need.
For the Seller
- Sign the title correctly. On a California title, the seller signs on Line 1 and prints on Line 1A. Date the transfer. Complete the odometer disclosure section if the vehicle is less than 10 model years old.
- Write the bill of sale. Include date, vehicle info (year, make, model, VIN), purchase price, and both parties’ names and signatures.
- Get a smog certificate unless the transfer is exempt (family gift, newer than 8 model years, etc.).
- File the Release of Liability (REG 138) within 5 days of the sale. This is the single biggest mistake sellers make — if you don’t file, you stay on the record as the registered owner and can be liable for tickets, tolls, and accidents for years.
For the Buyer
- Verify the title before you pay. Make sure the seller’s name matches the title. Check for lienholders (legal owners) — if there’s an active lien, the lienholder has to release the title first.
- Get a complete bill of sale.
- Verify the VIN on the vehicle matches the VIN on the title. VIN mismatches cause registration to fail.
- Transfer within 10 days of the sale to avoid late penalties. California charges a $15 late penalty if you file more than 10 days after the transfer date on the title.
- Bring your ID, proof of insurance, smog certificate, and the signed title to us or a DMV field office.
Family Gifts
Gifts between immediate family members (spouse, parent, child, grandparent, grandchild, sibling) are exempt from use tax. Complete a Statement of Facts (REG 256) declaring the relationship and the gift nature. A bill of sale showing $0 isn’t enough — you need the REG 256.
